I have a telephone connected to xxx-xxx-xxxx. On [date] [dates], I received telemarketing sales call(s) despite the fact that [I registered my phone number on the national do-not-call registry more than three months before that date] [I asked on [date] to have my phone number placed on your company's do-not-call list]. -or- I have a telephone connected to xxx-xxx-xxxx. On [date] [dates], I received prerecorded telemarketing sales call despite the fact that I've never given you express permission. -or- I have a telephone connected to xxx-xxx-xxxx. On [date] [dates], I received telemarketing sales call(s) that I believe were automatically dialed, despite the fact that I had previously instructed my telephone carrier that I did not with to receive automatically dialed calls. Under both Massachusetts and state law, it is illegal to make telemarketing calls in the circumstances outlined above. Under the Telephone Consumer Protection Act of 1991 (the TCPA), 47 U.S.C. sec. 227(b)(3), I am entitled to recover $500 statutory damages [for each violation of the law]. [I believe that you committed a knowing or willful violation of this federal law, such that a court could award three times that amount in damages.] [Under the Massachusetts Telemarketing Solicitation Law, G.L. c. 159C, sec. 8(b), I am entitled to recover $5,000 statutory damages for the xx calls I received from you during the 12-month period ending xx/xx/xx. This remedy is in addition to my rights under the TCPA.] Your violations of Massachsuetts and federal law are unfair or deceptive acts or practices in the conduct of trade or commerce, and they are illegal under chapter 93A of the Massachusetts General Laws. I hereby formally demand (a) that you (and anyone you hire) cease and desist from phoning me in violation of state and federal law, and (b) that you tender an acceptable offer settling my claim for $xxxx against you within 30 days. Should you not do so, you could be liable for multiple damages and attorneys' fees in court.
